    Need Advice

    Hi
    I am about to make a website and going to launch it within few days. This is my first website. What I wanted to know from you people is how do I make sure I am complying with all FTC rules and regulations. Could the products I sell physically injure someone and how can I protected myself in that event? Is there any way I could harm my self or my business without any notification. I need your suggestions

    Get a lawyer.... serious. That is the only way you will be sure. Too much false info on the web...

    I agree with Frank on this. A lawyer would know best.

    It is best to check with a lawyer before starting any business. They'll be able to advise you of any laws that pertain to your business, the best legal organization (corporation, LLC, etc.) to protect your assets, and on any special licenses or permits that you'll need. A good lawyer can be a bit pricey, but the fines and/or lawsuits you could face because you didn't go by the book could be a lot more expensive.

    Can you at least give 'us' a hint?

    Lawyers suck!

    The reason this country (USA) is so screwed up is because half the government is ex-lawyers, and the other half ex-military -- or some combination thereof!

    Why would anybody want to consult either one of these groups concerning a web site?

    Are you planning on selling pipe bombs, or something?

    just as general commentary, the FTC would normally have Zero authority over you, it would be your state that you need to worry about, and/or the state governments you sell to.

    You would have to be really ****ing up to get the attention of the FTC

    if the product is legal for sale in the area your selling it in, you should not no Liablity,. You cant Sue walmart if someone stabs you with a knife they sold

    However you can sue ford if the car you bought Blew up due to a manufacturing defect

    The best protection you can get instead of a lawyer and a company is a trademark.

    This way you ensure your intectual property is protected.

    Lets see an example:

    A company that owned for several years the Adsense.com sufered a takeover from Google.com because it didnt had protected its rights, even it had a company.

    From a point of NICE classification (which is the one I know best), similar to USA International Classification, but with some minor diferences (USA has some diferent regulations from State to State, I guess, not sure), I sugest you to fill a trademark form in class 42 online information and so on.. class 38 telecomunications (online information can also be affected here), 35 advertising and so..

    If dont own a trademark you get owned

    Yes there are ways you can put your self in to a big trouble. Federal Trade Commission has already begun a sweep of Internet websites that 'are using deceptive and misleading statements.' So don’t think of putting any misleading information that could come back to you as a problem. I’ve seen a book called “How to stop the FTC From killing your internet business.” On (stoptheftcfromkillingmybiz.com)
